  1. “the Carrier and the Sender” refer to the users of ON MY WAY website and application for electronic transactions, and all expressions leading to that are taken into account. 
  2. The Company” refers to ON MY WAY company for electronic transactions (LLC), and all the expressions leading to that are taken into account.
  3. ON MY WAY website and application for electronic transactions refers to the above-mentioned definition.
  4. User Information” refers to the personal details that you provide via ON MY WAY website and application for electronic transactions

User’s Obligations

  • “On My Way” for electronic transactions (LLC) reserves the right to refuse providing any service or deny the use of the application without providing any reasons.
  • The user does not have the right to cancel any service after submitting the service request.
  • In order to have an access to “ON MY WAY” website and application for the electronic transactions, you need an internet access. You are responsible for any connection, service or fees related to the internet access, as well as providing all the necessary equipment that enable you to connect to the internet “including the computer, the modem and any other required equipment for access) due to the limited capacity of all server devices and their use by many people at the same time.
  • The user must refrain from using the application in any way that leads, or may logically lead, to interference of another party to use the application in a manner that violates, or is likely to violate, the prevailing and applicable laws or the legal rights and entitlements of any other party, in accordance with all applicable laws.
  • The user shall refrain from the following “whether performed by the user personally or through a third party”:
  • Using an automated process for the processing, monitoring, copying, extracting any pages existing on the application site or any information, content or data contained in or accessed through the application site without obtaining a prior written consent from us.
  • Using an automated process to collect or combine information, content or data that are contained in or accessed through the website and application, or materials and data accessed by, or originating from, a third party.
  • Using any automated process to interfere or attempt to interfere with the proper working method of “On my way” site and the application.
  • Performing any action that is likely to impose an unreasonable or disproportionately large load on the available infrastructure or bandwidth of the application site.

The company shall not be liable for any content posted, archived or uploaded to the interactive areas by you or any third party, nor for any loss or damage resulting therefrom.

The company is not responsible for any errors, defamation, slander, libel, omissions, falsehoods, abuse, obscenity or profanity that you may encounter while using the interactive areas.

The company shall not be liable for any statements, representations or content provided by users in any public forum, personal home page or other interactive areas. The availability of the website and application

Since the electronic services are subject to any disconnection or collapse, the access to the website and the application of ON MY WAY for electronic transactions is available as it is and according to its current status only.

We have the right, based on our absolute discretion, to impose limits or restrictions on your use for the website and the application of ON MY WAY for electronic transactions.

General

The Applicable Law: These terms and conditions and the On My Way website and application for electronic transactions are subject to the applicable laws in the United Arab Emirates.

Payment and Remuneration

On My Way for electronic transitions (LLC) displays all prices in the application according as suggested by users , the price will be determined by the carrier or buyer.

All details are appear in a pending invoice within the application containing the prices suggested by users and the service fees for the application.

The sender, in turn, chooses what suits him,

The company’s role is merely an intermediary between the carrier, the sender and the recipient.

General Definitions

The parties involved in transactions within the application are:

First: The Carrier

is a traveler who has a specified amount of available weight, which they exclusively determine and disclose their ability to transport it. The carrier specifies the size and dimensions of the weight, as well as the expected dates for pickup and delivery, along with the mode of transport the carrier will use. Additionally, the carrier provides all necessary information, including the destination, proposed delivery times, and the price for transporting the available weight, adding any expenses or customs fees related to the shipment and all their personal details into the app as well, indicating their acceptance.

Second / The Sender

This is an individual who wants to ship a certain weight or specific documents to a particular destination from a given location. The sender uses the app to search among available carriers and selects one that matches the shipment’s size, weight, point of departure, destination, pickup and delivery time, and suitable price for the shipment. The sender then accepts the offer.

Third: The Recipient
It is a third party who knows the sender, is identified by the sender, specifies his data and contact numbers, and this person receives the shipment from the carrier in the arrival area.

The following details are required for registration with the company for both the carrier and the sender

  1. A copy of the passport
  2. Valid e-mail ID
  3. Active mobile number in any country
  4. A selfie taken through the app
  5. Linking the bank account of the applicant
  6. The carrier will not be able to register unless the company approves the submitted documents.

With a notice that the fees of the special services of the carrier will not be paid though the application until the process is completed.

Service Fees and Payment Method

The sender shall be committed to pay the service fees to ON MY WAY, as determined by the carrier, in addition to a 20% surcharge applied to the issued invoice as a service fee for ON MY WAY. This payment is due when the offer and acceptance between the carrier and the sender are finalized, and it will be reflected in the sender’s total invoice.

In return for the services provided by the carrier, the company agrees to pay the carrier after completing the process in a proper and safe manner.

ON MY WAY PORTAL LLC will provide the service fees as determined by the carrier in advance and agreed upon by the sender.

A 20% of the fees will be added to the issued invoice as services fees provided by ON MY WAY PORTAL LLC.

If the carrier pays an additional invoice, including but not limited to (customs), he will send it to the sender via the chat channels available within the ON MY WAY PORTAL LLC application, and then the carrier, in turn, will also deliver it to the recipient in the country of arrival manually to be matched and verified. Then receive the paid amount.

ON MY WAY PORTL LLC company has the right to update the terms and conditions in a manner that suits its working mechanism without notifying the users in order to enhance the readiness of the application and maintain excellent performance at all times.

The carrier shall be responsible for customs duties in accordance with the laws and regulations of the country through which they pass, and they will be reimbursed later for the fees paid.

The carrier is not entitled to any claims if the receipts are not submitted within/outside the application.

Neither the carrier nor any other person is considered an employee of the company.

The company shall not be considered responsible under any circumstances for the safety of the sender, the carrier or the recipient.

None of these terms and conditions create or imply a partnership between the carrier, the sender, or the recipient and the company.

The company shall not provide insurance coverage of any kind for the carrier; instead the carrier shall, at their own expense, obtain any insurance coverage required by the laws of the country for conducting the delivery, wherever this is applicable.

The carrier must deliver the shipment/package according to the specified location and time and must always be update the system to inform the sender.

Upon the completion of the carrier’s delivery of the shipment to the recipient and proof of the actual delivery of the shipment, the application will transfer the carrier’s dues as detailed in the invoice attached within the application, in addition to any other fees incurred, for which the relevant documents are attached in the designated section of the application.

Inspection

On My Way does not reserve the right to open the shipment, as the entire responsibility lies with the carrier and the sender

A photo of the shipment will be added within the application in a designated section

The application advises all carriers to check the contents of shipments to ensure the quality of service

The company reserves the right to update the terms and conditions in line with its operational mechanism without notifying the users in order to enhance the readiness of the application and maintain excellent performance at all times

Receiving and Delivery

Shipments are received and delivered according to the location and time defined by the carrier, which is accepted by both parties and made clear to all parties from the outset.

In the event that the delivery process is not completed for a reason attributable to the sender and recipient, the shipment will be returned to the sender if the recipient refuses to receive it. However, this return will be chargeable and organized automatically through the application with the full fees payable to the carrier or another carrier, along with the return shipping fees for the application

The delivery process involves scanning a barcode sent by the application to the sender for forwarding to the recipient. When the carrier scans the barcode through the application, the transport and delivery process will be confirmed, and shipments will be delivered to the address provided by the client for the recipient.

Insurance:

On My Way provide insurance coverage up to a maximum of $200 0 for any scheduled shipment via On My Way. However, in case of claiming the overall amount of the shipment price, the client must pay an additional amount in advance to the insurance company (optional), as proposed by us, to have their claim fully processed and compensated

with consideration

to comply with the laws of by any country where the application is used outside the Kingdom of Saudi Arabia and the UAE and adhere to the terms and regulations in force of that country, and the legal responsibility falls on each of the carrier and the sender, in accordance with the laws of the country from which the shipment is sent and the country to which it is delivered. ON MY WAY holds no legal responsibility, either within the UAE or internationally

Guarantee:

Upon the carrier accepting the delivery request, the contract amount will be deducted from the sender’s account as a guarantee to the company, ensuring that the sender does not back out and that the delivery is successfully completed.

–The client must declare the contents and actual value of each shipment to ON MY WAY PORTAL LLC before the shipments are collected by ON MY WAY PORTAL LLC. The client will be solely responsible for any incorrect declaration of the shipment.

Unacceptable Shipments

A shipment is considered unacceptable if it contains any of the following:

  • Fully assembled firearms, ammunition, explosives, detonating devices, test pieces, air rifles, replica or imitation firearms; counterfeit goods; cash; bullion (of any precious metal); live animals, or parts or remains of prohibited animals, such as ivory; human remains or ashes; loose gemstones or semi-precious stones; cannabis or its derivatives; or illegal goods, such as narcotics or other illegal substances.
  • All items classified as hazardous materials, dangerous goods, or prohibited or restricted materials under ADR (the European regulation for the transport of dangerous goods), or by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), or other relevant bodies (“dangerous goods”).
  • All items containing anything prohibited under any law, regulation, or legislation.
  • All items containing bullion or currency.
  • All items containing negotiable instruments in bearer form, such as bearer checks/money orders, postal orders, promissory notes, bearer bonds, bearer share certificates, stamps, open tickets, non-cash travel checks, credit cards, or SIM cards (excluding gift cards).
  • Any item that violates the customs regulations or practices of the destination or origin country
  • All items containing anything that violates the customs and practices of the destination or origin country.

Packaging:

The responsibility for packaging the shipment lies solely with the client. ON MY WAY PORTAL LLC assumes no liability for loss or damage to the shipment resulting from inadequate packaging.

ON MY WAY PORTAL LLC will not be responsible for any delivery delays resulting from the client s failure to fulfill their obligations in this regard.

If the shipment is deemed unacceptable, the recipient’s identity or location cannot be reasonably determined, or the recipient refuses to accept it, the carrier must make reasonable efforts to return the shipment to the sender. The return of the shipment will be at the sender’s expense.

If the shipment cannot be returned, it may be released, abandoned, disposed of, or sold without any liability of any kind to the sender or any other party.

ON MY WAY PORTAL LLC reserves the right to destroy any shipment if it is prevented from doing so by any law or any law enforcement agency, and the company is not obligated to return it, either wholly or partially, to the sender, including any shipment of hazardous goods.

Routing:

The client agrees to all routing and redirection processes, including the possibility of the shipment being transported through intermediate stops.

Claims

All the claims must be submitted in writing to ON MY WAY PORTAL LLC within fourteen (14) days from the date that ON MY WAY PORTAL LLC approves the shipment. Failure to do so will result in ON MY WAY PORTAL LLC bearing no responsibility whatsoever. The claims are limited to one claim per shipment, and its settlement thereof will be a full and final one for all the related losses or damages.

Client Acknowledgements, Guarantees, and Indemnities:

The client agrees to indemnify and hold ON MY WAY PORTAL LLC harmless from any loss or damage arising from the client’s failure to comply with the following warranties and declarations:

  • The shipment is acceptable for transport under the aforementioned section (lists of prohibitions and restrictions).
  • The client complies with all applicable customs, import and export laws, data protection regulations, sanctions, prohibitions, and other applicable laws and regulations.
  • The client has provided all information, permits, licenses, authorizations, and other governmental documents as required by applicable law or upon request from ON MY WAY PORTAL LLC, and all information, permits, licenses, or authorizations provided by the client or their representatives are verified, complete, and accurate, including the value and description of the goods and information about the client and recipient.
  • The client has obtained all necessary approvals regarding the personal data provided to ON MY WAY PORTAL LLC, including recipient data that may be required for transport, customs clearance, and delivery, such as email address and mobile phone number.

Limits of Responsibility

 — ON MY WAY PORTAL LLC will be responsible for the client’s shipment only when it is under the care and control of ON MY WAY PORTAL LLC. The company will not be liable for any loss or damage to the shipment when it is outside of its control. ON MY WAY PORTAL LLC’s liability is limited in any event to a maximum of two hundred dollars (USD 200) or its equivalent for each shipment, which may be less than the stated amount depending on the content of the shipment, the accuracy of the entered data, and the extent of the damage or error incurred. Regardless of the above, the maximum insured value for any shipment accepted by ON MY WAY PORTAL LLC is two hundred dollars (USD 200), and ON MY WAY PORTAL LLC will not exceed this amount under any circumstances.

 —Notwithstanding the above, if the client declares a value higher than two hundred dollars (USD 200) on the shipping invoice at the time of data submission, ON MY WAY PORTAL LLC’s liability will still be limited to the lesser of the declared insured value or the amount of any actual loss or damage incurred by the client. The actual value of the shipment will be ascertained by reference to the replacement and remodeling or rebuilding value at the time and place of shipping, whichever is lower, without reference to its commercial utility to the client or its moral value or to other items that may be subject to subsequent loss.

—ON MY WAY PORTAL LLC will under no circumstances be liable for any indirect, special, incidental, or consequential damages or other losses of any kind, whatsoever, whether or not ON MY WAY PORTAL LLC was aware of the possibility of such damages, including but not limited to loss of income, profits, benefits, or market loss.

—The client will be responsible for all losses, damages, and expenses arising from their failure to comply with their obligations under this agreement due to negligence. In the event of a claim for the full value of the shipment, the client must pay an additional amount in advance to the insurance company recommended by ON MY WAY PORTAL LLC in order to fully compensate for the total value of the shipment.

Circumstances Beyond the Control of ON MY WAY PORTAL LLC:

ON MY WAY PORTAL LLC is not liable for any loss or damage arising from circumstances beyond its control. These circumstances include, but are not limited to:

  • Electrical or magnetic damage to photos, data, electronic or photographic records, or their erasure.
  • Any defect or characteristic inherent to the nature of the shipment, even if known to ON MY WAY PORTAL LLC.
  • Any act or omission by a person not employed or contracted by ON MY WAY PORTAL LLC, such as the client, recipient, third party, customs, or any other government official.
  • Third-party cyberattacks or other information security threats.
  • “Force majeure” events, such as earthquakes, hurricanes, storms, floods, fog, war, plane crashes, embargoes, riots, pandemics, epidemics, civil unrest, or industrial action.

Returns:

– In the event that the shipment remains in the possession of ON MY WAY PORTAL LLC for more than twenty-one (21) days, ON MY WAY PORTAL LLC reserves the right to return the shipment to the sender for an additional fee to be paid by the sender.

– In the event that the carrier fails to execute this agreement and/or fails to accept the returned shipment, ON MY WAY PORTAL LLC will have the right to dispose of such shipment at its discretion, without the need to take any further legal action, or obtain an order or judgment from the court in this regard. The client shall indemnify and hold ON MY WAY PORTAL LLC harmless from and against any third party, including official authorities, claims, liabilities, taxes, penalties or obligations of any kind whatsoever that may arise from or in connection with the disposal of such shipment.

– The client must follow the laws of the country in which the ON MY WAY PORTAL LLC application is used. However, any dispute shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Dubai Courts shall have jurisdiction to settle disputes.

– Any client using the ON MY WAY PORTAL LLC application outside the United Arab Emirates must adhere to the laws and regulations of the country in which they are using the service. Nonetheless, all disputes shall be resolved by the courts of Dubai, UAE

– Severability:

The invalidity or unenforceability of any provision shall not affect any other part of these terms and conditions. Each provision of this agreement is considered separable. If, for any reason, any clause or part of a clause is found to be invalid or in conflict with any applicable law, whether current or future, such invalidity will not impair or affect the operation of the remaining parts of this agreement. The illegal part will be removed, and the remaining provisions of the agreement shall remain valid and binding on all parties involved.

Data Protection:

UAE Federal Decree-Law No. 45 for 2021 on the protection of personal data will be applied if there are any disputes over data protection.

Acknowledgement and Indemnification

The carrier must indemnify and hold the company harmless from any loss or liability arising from the carrier’s failure to execute deliveries in accordance with the stipulated terms.

Governing law / Jurisdiction

Dispute Resolution, Governing Law and Jurisdiction

Any disputes arising among the carrier, the sender and the company relevant to the stated terms shall be settled amicably among these parties. If they fail to resolve the matter amicably, the dispute will be referred to the courts of Dubai, UAE.

Similarly, any disputes between the parties related to the terms of this agreement should be resolved amicably. If amicable resolution fails, the dispute shall be referred to the courts of Dubai, UAE.

This agreement is governed by and shall be interpreted in accordance with the laws of the UAE. The courts of Dubai shall have jurisdiction over any disputes arising in connection with these terms and conditions.
